Texas Justices Could Decide ERCOT’s Immunity

The case presents an interesting question for the court because of what David Coale of Lynn Pinker Cox & Hurst LLP called the novel structure of the organization. He said it is analogous to the Financial Industry Regulatory Authority, in that ERCOT exists because of Texas law but isn’t a state agency, just as FINRA exists because of federal securities laws but isn’t a federal agency.
