When it comes to proving sanctions against an attorney, the Texas Supreme Court held in a closely watched April ruling that practitioners must show the alleged harmful conduct was carried out in bad faith.

But the ruling shouldn’t be read as a “green light for attorneys to engage in unethical behavior,” said Kelli Hinson of Carrington Coleman Sloman & Blumenthal LLP. Hinson said courts still have the power to sanction attorneys practicing before them, and that finding bad faith isn’t “too much of an additional burden.”
