With the recent sub-freezing temperatures and power outages in Texas and surrounding states, many businesses may be questioning if their insurance will cover any losses. The answer is “maybe.”
“It depends on how the force majeure clause is written in your policy and whether weather is in the clause,” says Josh Sandler, an attorney with the Dallas firm of Lynn Pinker Hurst & Schwegmann. “Most policies won’t cover weather events unless there is actual property damage.”
He says that some companies may carry business interruption insurance, and if so any potential losses will need to be carefully documented.
