Attorney Kathy Barrow of Fox Rothschild in Dallas represents the residents in a lawsuit against the state of South Dakota. During the 20th century, the state made money by mining gypsum beneath the land, then failed to reclaim it properly before selling to a developer who built homes.
“I mean, you spend your whole life putting money and building equity in your home. It’s your most prized asset, and these people’s assets had become not only worthless but almost a negative because they’re dangerous to live in,” Ms. Barrow told the Associated Press.
The lawsuit seeks $45 million in damages for the affected families, arguing that their homes have become unsafe and devalued due to the state’s failure to disclose issues related to the land before its sale.
