SAN ANTONIO - Attorneys from the Corpus Christi, Texas-based law firm of Hilliard Muńoz Guerra LLP are announcing a lawsuit filed against the developer and builder of a northwest San Antonio neighborhood that was severely damaged in the recent collapse of a retaining wall.

Attorneys Robert Hilliard and Reynaldo Peņa represent Luis and Janice Jimenez in their claims against Bloomfield Hills, Mich.-based Pulte Homes Inc. and Dallas-based Centex Homes. The case was filed today in the 37th District Court in Bexar County, Texas.

On Sunday, January 24, a retaining wall failed in The Hills of Rivermist community, causing the ground to cave in throughout the neighborhood. The wall collapse and shifting soil damaged several homes and displaced dozens of families.

According to the lawsuit, shoddy construction practices led to the failure of the retaining wall and the resulting landslide near the home purchased by the Jimenez's in 2006. The lawsuit includes claims of negligence and fraud against Pulte Homes for failing to submit plans and obtain permits for the construction of the 30-foot-tall, 1,000-foot-long wall.

"This is basically a man-made disaster which resulted from decisions by contractors and engineers to move quickly and build sloppy," says Mr. Hilliard. "Those costly decisions put these homes and the families that bought them in danger of sinking ground and falling property values."
